ORANGE, TX -- Three years after the slaying of a man in broad daylight, a family seeks justice for Lance Cpl. James Whitehead (USMC).
"He told him 'I'm going to kill you,' and then he killed my friend," said Randy Edwards who witnessed the attack.

Whitehead was inside of the O'Reilly Auto Parts store in Orange, TX, on July 26, 2010. After a dispute about an item being returned to the story, an off-duty police officer got involved and followed Whitehead outside to the parking lot, where they argued.
"I could see (off-duty Orange police captain Robert) Arnold was out of control," Edwards said, recounting the events. "He came at James (Whitehead) with the intent to kill him and that is exactly what he did. It was all just so crazy to get to that point. There was a yelling, then there was a shooting. Then (Whitehead) was dead."
Whitehead was shot at point blank range. Forensic pathologist and medical examiner Tommy Brown said Arnold was no more than 8 inches, possibly even less than 6 inches, from Whitehead when the fatal shot was fired -- a close proximity for an officer to be in if he felt he were in danger, Orange Police Department investigators pointed out.
His last words, said Edwards, were directed at the man who pulled the trigger to end the Marine's life. "James stood up and said, 'You shot me,' while looking Arnold in the face," Edwards remembered in detail. "Arnold just looked at him and said, 'I damn sure did.' Then James just fell back in the truck and died."
Edwards told this witness account to police within minutes of the shooting. However, Officer Robert Arnold was never charged with any crime. His shooting of Whitehead was ruled a justified shooting, and arbitrator Leroy Bartman ordered that Arnold, who was placed on indefinite suspension, be put back to work. A judge threw out this order in 2012.
However, the family still seeks justice for their murdered family member.
